I’m not a lawyer by any stretch but I just have to clarify a few things. An affidavit is a statement signed pertaining to a set of facts, such as I saw Person A throw the first punch in a fight or I saw Person B rob that 7-11. It is not used as such in contract law, except no doubt in ascertaining certain events or facts regarding contract disputes,

What you are referring to would no doubt be either a release that they would sign or a clause in their contract. I have no doubt that a similar clause to this is already in their contract as it is contained in most workplace agreements. However, this would not absolve CA of any responsibility regarding this. They still have a duty of care under Tort law towards their players regarding their well being. That is no doubt why Bracken is suing because there may have been a breach regarding duty of care. That would definitely be the case with someone playing who is injured or suspected of being injured if CA allowed them to play.

In regards to playing whilst possibly injured, I think it is easy to forget that these players are investments by CA, rather than individuals. Not only have they used numerous resources to get where they are such as specialist coaching, grants and such, which means that they expect some return on their investment. Not only that, if a player gets injured during the season, CA still has to pay them, despite not being able to perform. It therefore makes sense that these players are rested or not played at stages because no doubt CA has experts regarding their overall well being. It may not be popular at times but I trust a Dr or a Sports Scientist to tell me what is wrong and its possible consequences rather than rely on me. No doubt some players will resent this but ultimately it is not up to them and nor should it be.
