More bloody acronyms: AFLPA weigh in on ASADA, CEOs and the ADRVP

AFLPA chief executive Paul Marsh had announced on Thursday morning that there would be no response to ASADA’s show cause notices.

The association called on ASADA to speed up the process by taking the matter to the Anti-Doping Violation Panel within seven days.

Marsh said it would be “simply unacceptable” for the saga to extend into a third AFL season.

“In the event that ASADA is not able to meet that timeline, ASADA has been requested to simultaneously provide the AFL General Counsel and the players’ legal team with all the documentation and evidentiary material it has in this matter so that the matter can be dealt with in accordance with the AFL Anti-Doping Code,” Marsh said.

But ASADA is unimpressed with the association’s request.

“ASADA has written to the players’ lawyer to remind him that the demands are inconsistent with the mandatory provisions of the National Anti-Doping scheme and as such, ASADA is unable to agree to them,” the anti-doping body said in its statement.

“ASADA reminded the players’ lawyer that the ADRVP is a separate and independent body to ASADA and the CEO has no legal power to direct the function of the ADRVP or to dictate the timing of its consideration of cases.

“ASADA also reminded the players’ lawyer that a number of their demands for fast-tracking the process were within the control of the AFL, and not ASADA.

“The CEO of ASADA does not have the power to direct the AFL to expedite anti-doping cases before its tribunal.”

ASADA issued original show cause notices in June to 34 current and past Essendon players.

Essendon and coach James Hird then launched Federal Court action against ASADA.

After those legal challenges failed, the anti-doping body went ahead earlier this month with amended show cause notices.

Hird is appealing against the Federal Court finding, but the club has accepted the verdict.

“It was appropriate for ASADA to delay the delivery of evidence in these matters until a judgment was handed down,” the anti-doping body said.

“In the normal course of events, the comprehensive summary of evidence provided to players in the amended show cause notices in October would have been available to players back in July.

“ASADA is as keen as anyone to finalise these matters, but it will not risk the proper consideration of these serious matters for the sake of speed.”

ASADA added the players have until October 27 to respond to the show cause notices.

Mark - See today it has been revealed that Thymosin Beta 4 requires an injection regime of 1 injection each weekday for 10 weeks (50 injections) while Thymodulin requires 1 injection a week for 6 weeks (6 injections) - Dank admits this difference in regimes by the way - can you guess which regime the Essendon players were subjected to?

Sam, can you outline 'every dirty trick', as well as 'smearing/spinning/disregarding truth (totally!!)'. and what 'truth' do you refer to?. How are they responsible for the duration? Essendon wanted an independant PUBLIC hearing over this, the AFL did not. One of the reasons Hird went to court ( I suspect) was to have his say. The truth is (re: court case), the AFL have, from the very beginning lied and spun the 'truth' for an outcome they had pre-determined, all because of that modern day demigod, the 'brand'. if this didn't involve men wearing particular colours, we would (should) all be outraged. Former WADA cheif John Fahey said in May, he suspects the investigation was political grand-standing. Essendon's court hearing confirmed that politics were at play, with little regard for the 'truth'. Essendon have been punished for their shortcomings. If your view is Essendon have done all this 'unethical spinning', why would you want players banned for 2 years? Sorry, I forgot. They wear particular colours.

Innocent until proven guilty? You haven't read the ASADA and WADA charters have you. They don't need to prove anything. As long as they have their evidence. Of course what would blow ASADA of the water are the records showing dates, names, what was injected, when it was injected and by whom. Sadly, Essendon appears to have mislaid the,. Funny that.

Macca, Now you are providing ASADAs bombproof arguement that Essendon players were administered TB4. Let us disect your case. I can see why you are comfortably satisfied that the players have been administered TB4. "Dank admitted he injected Thmosin Beta 4" True re he said this... issue is that the statement contradicted his description of how the specimen was used for immunity. He has also said under oath to the ACC that he administered the legal varierty of thymosin. He later told the reporter that he made a mistake when he said TB4, but that was excluded from the article. "Charters say he supplied Thymosin Beta 4 to Dank" Charters brought a small dosage of TB4 into Australia as well as the legal variety of Thymosin. This is recorded by customs. Danks own company sells TB4 directly to the public. There is a phantom invoice that Charters claims was provided by Dank to Charters that orders a substantial quantity of TB4. Issue is that if this quantity was actually purchased, it would cost around $1,000,000. "Thymosin Beta 4 was stored at the EFC, Essendon was invoiced for Thymosin" Who saw TB4 at Essendon? The Chinese Company made a very clear distinction between Thymosin and TB4. Only ASADA calls Thymosin TB4. Everybody else refers to thymosin as being the legal variety. "Hird discussed the use of Thymosin via text and of the 2 forms of Thymosin only the illegal 1 performs in the manner discussed in the text" You mean thymosin is used by Essendon to assist with soft tissue repair and he told Dank to please administer it to out players. "The fact Essendon had such poor governance is likely to cause the players to face suspension." You mean it should have been ship shape like Lance Armstrongs governance and that would have made everything OK. OK, now you believe all 34 players receieved exactly the same specimens which includes TB4 for all. Or at least we think they might have. Maybe.

Did you see the bloke Coles Myer employed as their CEO not so long ago - they sacked him because he didn't have the credentials. The fact Dank was employed elsewhere doesn't make him nay more qualified.

Macca, if you are saying that Danks credentials were not sufficient to perform the role, his history in that position is critically important.... no need to swear about it mate. He was employed by Manly Sea Eagles as a highly credentialed Sports Scientist. He was there for 4 years and won 2 titles including a smashing of Melbourne Storm. He was in all of their winning premiership photos. Manly gloated about their science man. There were articles written about the wonders of actovegin. Gold Coast Suns.. recommended by the AFL (do you believe it). Dank helps Robinson at Geelong. Are you aware of all of this Macca? Do you think he is qualified enough?

But I am sure you are right, the fact Dank purchased TB4 off Charters and discussed with Hird Thymosin behaving in the exact same way TB4 does shouldn't be any cuase for concern. That said have you ever wondered why given 1 form of Thymosin is legal and 1 is illegal why Essendon were invoiced for "Thymosin" - wouldn't you want to make it perfectly clear that you were buying the legal variety? Do you realise that Sports Science Degrees did not exist when Dank studied. They are a fairly new. Also, I have heard the stories before that Doctors and Physios do not believe in Naturopaths and Chiropractors and none of them support Chinese medicine. Each has a purpose and as long as they stay within legal guidelines and are experts in what they do, somebodies opinion of you doesn't really matter. I would have thought in the case of the Essendon players all that really matters is that nothing illegal was administered. And that is the case. Comments?

Given those 2 things it is incredulous that anyone can say nothing illegal was injected and given the fact that Dank admitted he injected Thmosin Beta 4, Charters say he supplied Thymosin Beta 4 to Dank, Thymosin Beta 4 was stored at the EFC, Essendon was invoiced for Thymosin, and Hird discussed the use of Thymosin via text and of the 2 forms of Thymosin only the illegal 1 performs in the manner discussed in the texts the fact Essendon had such poor governance is likely to cause the players to face suspension.

Mark - Who gives a f..k who appointed him to the other clubs, errors made by others don't exonerate Essendon! And those other clubs may have had oversights that prevented him going to the lengths he did at the bombers, it may be that only the bombers had such complete faith in him and lax standards that he was able to implement his experimentation regime - who knows and who cares - the facts the director of Australia’s peak body for sports scientists says his qualifications wouldnt be enough to register him as a sports scientist with their body, he says it was “beyond highly unusual” for a person in Dank’s role to oversee a program of supplement injections, Dr Reid questioned the practices being employed, Zwitkowsky found a culture of experimentation and you don't think Hird could have done any more? Give me a break! And I see no comment on the procedures I suggested when you asked "What sort of oversight do you recommend?"
