Twist in the Beale-Patston saga: reports of evidence manipulation

The Kurtley Beale-Di Patston saga simply won’t go away, and there have been new revelations ahead of Beale’s hearing at the ARU Code of Conduct Tribunal today.

According to a sources as well as a report in the Daily Telegraph today, doubt has been cast over the veracity of some of the evidence put forward accusing Beale of sending untoward text messages.

The Telegraph has reported that the most offensive of the texts leaked to the media, widely considered to have been sent by Beale, may have been sent by a third party. The Roar understands that this scenario is being considered by the ARU, and Beale and his team will put forward evidence to that effect at the tribunal today.

There is also mention in the Telegraph’s report that “the ARU have accepted that the alleged text exchange between Beale and Patston tended as evidence in the Wallabies star’s code of conduct hearing has been manipulated”.

The Roar can’t confirm whether or not the evidence was manipulated, but there is strong consideration being given to the scenario that it may not have been Beale that sent all the messages that have been released to the public.

The report from the Telegraph that Beale’s camp will submit phone records as evidence, allegedly at odds with what was originally seen by the ARU, seems to be on the money as well.

There is no doubt that Beale sent at least one offensive text message. Whether this could amount to an about-face from the ARU is still up in the air. It has opened up the possibility of Beale being suspended for the end of year tour only. If this is the case, Beale will have the opportunity to stay in Australian Rugby next year, but European clubs have also shown interest in his services, and it has been reciprocated from the playmaker.

It is widely known and reported that Michael Cheika is a fan of Beale’s play, but it’s understood this will have no bearing on the result today.

He still has to face the independent three-man tribunal today, and they will assess all the evidence tendered and determine Beale’s fate.

Mark Williams, a district court judge, John Boultee and Dominic Villa will sit on the Tribunal.

"all the players are only a teleconference away" I reckon that is something the ARU really want to avoid, because then the obvious questions about who received what and when and then what did they do (or not do) about it may be asked, along with the question of whether sharing this style of message was usual for the players and then it gets much messier and worse all around. My view is that KB should get some meaningful penalty, but then the problem is that all the other players that may have been involved won't even be named, much less have a case to answer. Perhaps some players giving KB their unquestioning support could really be acting from very selfish motives if it transpires that KB carries the can for all of them. Regarding post-editing the messages on a phone: it is essentially a hackable computing device, however I very much doubt that anyone in the regular employ of the ARU (on or off the field) would have that ability. And like all hacking, it's not the hack that's the tricky part, it's doing it without being detected...

I wouldn't have thought it would have mattered so long as it wasn't Beales' phone. Not sure about the rest - don't know how post-editable SMS messages are. I'm not sure how much traction he'd get with an "ARU is trying to frame me" defence though, and at worst all the players are only a teleconference away.

I should clarify that I'm not calling the tribunal a clown show, rather the multitude of leaks to the multitude of journalists from the multitude of sources. @AndyS - the physical phone would be good evidence, but you would probably need someone to confirm that it was indeed the phone in question and then you may have to answer queries about the handling of the phone to rule out any interference from any other parties... especially if the ARU has had possession of it for a couple of weeks during which time the contents of SMS conversations using that phone have been published in the newspapers. Do you see how it suddenly gets murky without people directly involved being there to explain what happened (say the purported three man mediation mission)?

It’s a PR problem, it’s a customer perception problem, it’s a marketing brand problem with legal ramifications. Your learned arguments just serve to cement the conclusion that when you go to the legal mattresses, your landlord is your lawyer.
