Kurtley Beale stood down: investigated for inappropriate text messages

By The Roar / Editor

Wallabies playmaker Kurtley Beale has been stood down from Wallabies selections after fresh allegations emerged about inappropriate and offensive text messages he distributed in June this year.

The messages allegedly reference an ARU staff member, and the new investigation follows Beale’s clash with Wallabies Team Manager Di Patston last week.

Beale was dropped from the Wallabies bench following the altercation with the ARU staffer on the plane from South Africa, after he was allegedly told to change his shirt.

The new allegations relate to messages and images allegedly distributed by Beale in June of 2014, which the ARU consider to be “highly inappropriate and deeply offensive” referencing an ARU staff member.

The ARU has referred the allegations to a code of conduct tribunal, and Beale will be unavailable for selection for the Wallabies until the tribunal reaches a conclusion.

“This matter relates to Kurtley Beale allegedly distributing what we consider highly inappropriate and deeply offensive text messages and images to a number of people in June, referencing an ARU staff member,” Mr Pulver said.

Although the indicident allegedly occurred in June, ARU CEO Bill Pulver says this is the first time management were advised of the issue.

“We became aware of this incident this week and believe an independent Tribunal is the appropriate forum for these allegations to be considered,” Pulver said.

“This also provides Kurtley with an opportunity to present his response to the matter through an impartial process.”

Beale is also still facing action for the altercation with Ms Patston on the plane, with Pulver saying that investigation was ongoing, but hints that it is of less concern than the new allegations.

“The investigation into the argument on the plane has become a secondary matter in recent days, with our focus diverted to these new allegations. We will finalise the investigation into the in-flight argument in due course.”

The precise nature of the messages being distributed is unclear at this stage.

Any connection between the two incidents is also unclear.

The Roar understands that Ms Patston is currently on sick leave.

The tribunal will be chaired by District Court Judge Mark Williams and will include representatives nominated by the Australian Rugby Union and the Rugby Union Players’ Association.

The date for the hearing will be set in coming days, but it is expected to proceed early next week.

i agree, and hopefully not rush to make a call until the answers come in, though i personally doubt he would have come out so quickly unless he was very confident it wouldnt come back to bite him. one explanation for that is he's telling the truth. but when the investigations done i think the aru wont be able to sweep any anti link truth under the carpet. in that scenario they make beale the scapegoat but beale isnt at the end of his earning potential and need the payout like tuquiri was and doesnt have as much to hide if all he did was send dodgy text messages which we know already. he'd be happy to tell all i'd say if they punt him now. plus i can live without ever knowing. the decision makers will know and make their decisions accordingly.

Until McKenzie satisfactorily justifies his decision to miss a team function in Perth and a training session in Mendoza to instead accompany Ms Patston to the airport - our choice remains to keep asking questions.

This one is of interest (from mondag Newsletter: Australia: The little tweets that cost $105,000 for defamation - Last Updated: 4 September 2014 Article by Delvene Michael - Coleman Greig Lawyers - LinkedIn Twitter Facebook In a landmark decision, and the first of its kind in Australia, the New South Wales District Court has ordered a former student of Orange High School to pay $105,000 to a teacher for defamatory tweets. In the case of Mickle v Farley, Ms Mickle sued the former student for defamation because of a tirade of comments he posted on Twitter (and Facebook) about her. The former student seemed to believe that Ms Mickle had something to do with his father leaving his job as head of music at the school - beliefs that were unsubstantiated by evidence. Although the tweets and posts were removed within a couple of weeks and an apology made by the former student, the Judge awarded Ms Mickle $105,000 for the effect it had on her life. Ms Mickle went on sick leave shortly after the comments were made and could only return to work on a limited basis. Don't be fooled into thinking this doesn't apply to you. If you have any type of online presence via social media, whether as an individual or a business, then take note. The effects that defamatory comments may have can be devastating. Even if deleted within minutes, chances are that numerous people have already seen it and may have even shared, retweeted or saved the comment causing a domino effect of damage that may not be apparent immediately. This serves as a timely reminder that you can never be too careful when posting comments online. The damage an inappropriate comment may cause to your personal life or your business can be costly and devastating. If someone can prove that you have damaged their reputation then legal action can be taken against you. Be aware that this applies to comments on portals such as Snapchat or Instagram too! The content of this article is intended to provide a general guide to the subject matter. Specialist advice should be sought about your specific circumstances. This tends to support your comments PR - will post additional research later. Its 5 oclock somewhere so time for ...

No seriously AndyS, what you're saying is not and never has been the law of this country. Jibba, you might help us out with a reference to the case law that you're relying on. You might remember that Bob Ellis honestly believed a story about a politician's wife and then wrote a book including that story. Do you remember how much Ellis was ordered to pay? As far as "who you go after" the answer is you go after everyone you can. You might have noticed that media outlets have stopped short of making the kind of scurrilous accusations that have been posted here. Why do you think that is? So, Ms Patston, I don't know who you are except that you work for the Wallabies and that you and Kurtley have had issues. Those issues are being investigated. You are not being investigated. Kurtley is. I don't know what your marital or relationship status is so I'm not going to comment on it. I don't know what you do at the Wallabies so I'm not going to comment on whether your job is critical or peripheral or how good you are at your job. I don't know whether you made a complaint about Kurtley or whether someone else did. If you made the complaint Im not going to try to guess whether you had any motive because I still don't know who the hell you are. Of course, there are others on this site who have quite novel views about what you're able to say about people in public. They are of course courageously posting under false names. The Roar, which I love reading and posting on, seems content allow this stuff to be posted on their site. It is now entirely a matter for you.

@Tigranes : well I happened to read the interview the lady gave to one english tabloid. it was porn.!!! (circa 2006) however, it explains his success with the ladies , as she said he had 8+ and was very kinky :P i think he got sacked becoz of what she said about him (that he had sex with her in the FA offices , etc.) more than anything else , coz his coaching was ok and never interfered with his affairs.

Hi Roarers, I seem to remember somewhere that Di Patston said in the heat of the moment on the plane to Kurtley that his career was over or something to that effect. Would that now tie in with her arriving home and now these allegations have surfaced about the inappropriate text et. I feel sure that the lady has reported the matter to Pulver in retaliation for what was said on the plane. You don't mess around with a woman. Still Kurtley is too young to know this. I'll bet he now is much better informed about arguing with a woman. This will roll on for a time until his contract runs out, the ARU will not renew it and Kurtley Beale will be playing league next year or perhaps saying something in froggy tones

So who's telling the truth, Rhino? Actions speak louder than words is a recognised truism that applies to this drama very well. If it's there, it'll come out sooner or later.

I think you place to much faith in law. By itself it wouldn't be, but it would probably suffice if it was clearly expressed as an opinion rather than a statement of fact and a feasible interpretation of known facts. Where you might fall down is that it would not likely be a matter of public interest, whereas people say stuff like that (and worse) every day about celebrities, politicians, companies, etc with no comeback.

Being reported now that McKenzie has officially denied any personal relationship with Di Patston and was also unaware of the inappropriate text till just before the Argies game, not in June as Georgina Robinson at Sydney Morning Herald wrongly reported today. But I doubt the conspiracy theorists in the pro-Beale camp will change their tune.

It is if she was !! Remember this site is 'an opinion' site and is stated as such at the top. Comments have been based and interpreted on information already provided in the public arena via the general media. The ARU is at fault here for the delay and muddling way they have gone about responding to the incidents and the press. There is case law to say 'honest belief' is reasonable and case law that says it is not - not sure on the latest interpretations... but this is too big a mess for anyone to start suing anyone commenting on already reported information and processes. You would go after the initial reporting media first - not the commentators or the commentating vehicles / agencies. The ARU would appear to be the ones most liable here given they are the employer of all parties.

Why should he be gone - in this matter all he has done is send a silly text, apologise for it and perhaps badmouth a person who by all accounts should not be in the organisation and has not earn't the respect of all parties....his position is recoverable - the coaches perhaps not. .

The Tah's had the Wallbies starting 2,7,9,10,11,14 and 15. If a team like the Chiefs had what the equivalent AB starters they'd have: Coles McCaw A.Smith Cruden or Barrett Savea Fekitoa Ben Smith I.Dagg. Plus the Tahs had Potgeiter who was in beastmode. Why is everyone surprised the Tahs won,,they had 7 Wallaby starters.

FFS, I just had time to listen to the end of that, and Waugh was gunning for a complete Tahs backline, including replacing Kuridrani with AAC at 13!!
