Queensland Reds have signed George Smith

Queensland have reportedly signed former Wallabies captain George Smith for next season’s Super Rugby competition.

Smith, who will be 36 by the start of next season, has been shopping for homes in the region and would be a replacement for current Reds openside flanker Liam Gill, according to News Corp Australia.

The 111-Test veteran has not played in Super Rugby since he left the Brumbies in 2013, the same year in which his international career ended.

However since then he has performed admirably in European rugby for Lyon and Wasps, where he was recently named the club’s player of the year.

He has since moved to Japanese club Suntory Sungoliath, where he is yet to play a competitive match, and recently assisted Eddie Jones as a breakdown coach during England’s successful Six Nations campaign.

Contract law differs from jurisdiction to jurisdiction. The basic principles remain. If both parties agree to dissolve, who enforces the contact? It's called rupture conventionnelle in French law. Termination of a contract by mutual agreement. The dissolving of a contract would essentially be a new contract agreement. What happens if they want to upgrade a player to get them to sign an extension? The original contract is dissolved by mutual agreement and a new contract is agreed. If Mourad tried to terminate the contract the only person who could take action to uphold it is Cooper. If Cooper is wanting to leave then he is not going to. If Cooper tries to break the contract the only person who is able to take action to uphold it is Mourad. If he wants to get rid of Cooper then he is not going to. If neither party wants to enforce the other's obligations under the contract, then who is going to uphold it?

There are two parties to the contract. If both mutually agree it can be dissolved. The basic principles of a contract are universal. The only reason you uphold a contract if you want out is for fear of the other party taking legal action to enforce it, or gain compensation. If both parties agree, who is going to take legal action to uphold the contract?

Parties may be more willing to mutually terminate contracts in Australia. ' Australia is irrelevant the contract is held in France and under French and EU law. This has already been explained to you. The Reds are talking about signing him while he is still under contract with Toulon. It's also very difficult for Mourad to let an employee go under French law based on poor performance. If he decided to terminate Cooper on that basis then he will have to pay up.

Parties may be more willing to mutually terminate contracts in Australia. If Mourad is unhappy with Cooper as reported why would he want to continue to pay him? Common sense says that if Cooper and Mourad are both unhappy with the situation then mutually dissolving the contract is in both their benefits. Quade gives up the money to choose to go somewhere else and Mourad gives up the rights to Quade's services to use the money he feels is too high on another player.

He is still bound to a contract, there has to be a transfer fee for a contracted player. Contracts are far tighter in France and Mourad doesn't do business for free.

I predict that he'll play the house down next year and be back in the Wallabies 7 jersey for next year's June tests. With Pocock and Gill missing in action overseas, I would love to see him in Wallaby Gold once more.
