An estimated 10,000 Western Force fans have rallied in Perth against the Super Rugby club’s axing by the Australian Rugby Union.
Billionaire Force backer Andrew “Twiggy” Forrest said culling the Force was a “weak financial decision” and if the ARU wasn’t good at managing money they should “hand over to people who are”.
Rugby WA is expected to learn this week whether it will be granted the right to appeal the ARU’s decision in the NSW Supreme Court.
“This is absolutely not the end of the Western Force, it is not the end of rugby in Western Australia. Win or lose the appeal, we will get stronger,” ” Forrest told reporters after the rally outside RugbyWA headquarters on Sunday.

Absolutely Andy. But they could only possibly be liable for the duration of the agreement. What good are verbal assurances that do not align with a written contract? If that's what was agreed, why wasn't it just in the contract? I doubt that ARU has an agreement with the WA Government. But even if it did, surely the liability would be the total rent, over the total period. The cost of the facility is almost irrelevant to this, only the total rental revenue which was promised.

I suppose conversely, if you were a company and provided assurances to a property manager that if they built a new office block one of your departments would use it, and they built it, and you then pulled the plug on that division, telling them to just suck it up might not fly. Even if another tenant used some of the floor space... I imagine it depends on who wrote what to who ahead of the various developments I guess.

Clearly. That is why the WA government is threatening to sue the ARU. This is a warning to other codes who would be foolish to invest in the Perth market ever again. Your 20% stats are just as jumped up as the kiwis claims that Australia produces the same amount of players (30k vs a million). If WA is producing 20% of the current player pool then we certainly don't want anymore of them given the invisibility of their output.

Yes it depends on what contractual agreements the ARU have with the WA Government. Which is likely none though. Unless for some odd reason they engage on behalf of a franchise unlike anywhere else. And even then, they can only be liable for what the ARU committed to. The Alliance Agreement only guaranteed the Force to exist to 2020. How can the ARU possibly be liable for anything, other than rental income for the period 2018-2020?

None of us know exactly what was said or promised. The fact is the premier thinks a law suit is possible and is looking at pursuing one. To say they can or they can't is nothing more than supposition

The WA Government were willing to invest the money as long as the Force were guaranteed a spot in the competition. Expanding the stadium had nothing to do with the Perth Glory. The Glory play at a stadium that was expanded for Rugby and rent office space in offices that were expanded for Rugby WA.

It depends on what representations the ARU made to the WA government so that the WA government build the property. This ERU dug a very deep hole for themselves and cannot complain about being treated unfairly. The ARU Board needs to take responsibility for the mess they got themselves in and resign. Let's get rid of the nobodies on the Board and get people that knows rugby to make the decisions.
