De Goey likely to get plea deal charge downgrade over New York bar incident

AFL star Jordan De Goey will likely be offered a plea deal which downgrades his charges over an incident at a New York bar, a US court has heard.

The Collingwood utility via video link from Melbourne in a US court on assault charges on Wednesday.

The charges stem from an alleged assault at a Manhattan rooftop bar on October 30 last year.

De Goey has previously pleaded not guilty and the assault charges will now likely be downgraded to harassment.

Prosecutor Brendan Mahon told the court “the people are likely” to make a conditional offer of a plea deal for a harassment in the second degree assault charge.

De Goey’s lawyer Jacob Kaplan told the court he needed more time to find a counselling program in Australia for the AFL player to participate in as part of any plea deal agreement.

De Goey, who previously pleaded not guilty, confirmed he understood Judge Anna Swern’s instructions as both parties discussed the potential of a plea deal.

Prosecutor Brendan Mahon said they had obtained “video surveillance footage” of the alleged incident, but that “the people are likely” to extend a conditional offer of a plea deal for a harassment in the second degree charge.

Upon the court returning from an adjournment, Kaplan informed Judge Swern that the ADA would be offering a deal on one count of harrassment in the second degree once the defence had identified a suitable “program” for De Goey to complete in Australia.

The case was adjourned until January 28.

De Goey remains stood down by Collingwood.

For the record De Goey got less penalty from the Pies than Betts Walker and Houlihan got in 2009 for the Booze Cruise incident. At least they were fined the then maximum allowable as well as being barred from pre season training

In Victoria in 2019/20 78% of defendants pleaded guilty. Again that doesn’t equate to 78% of defendants being offered plea deals. Yes, but you need to take into account those who pled not guilty and lost to get the correct conviction rate. Of cases that would normally go to trial, a massive majority take a deal to get a lesser charge.

He's clearly a young man who to this stage of his adulthood seems unable to make responsible choices with the consumption of alcohol. Alcohol seems to either exacerbate aggressive tendencies and/or limit his capacity to control aggression in certain situations. After this matter has been settled, my hunch without feeling confident is that Collingwood will decide to play him in 2022 even if he and the club do end up parting ways at season's end.

Not wanting to stray too much into political territory but I had to laugh this week when Mitch McConnell claimed allowing legislation to pass with just 51 senate votes would be a step towards tyrannical demagogues and a slap in the face to democracy - this is a country where Alaska and California have the same number of senators, the electoral college means voters in smaller states have a bigger say than those in smaller states and elections are held every 2 years so even if a tyrannt does win power of all 3 levels of federal power they can't hold it. On tp of that judges are politically appointed and the supreme court is for life so even if someone manages to pass legislation their political opponents could defeat it in the courts BUT allowing the majority party to pass legislation on a simple majority is the bridge too far!!

Again different to a plea deal.
