GoFundMe removes Israel Folau's fundraiser over terms of service breach

Fairfax Media is this morning reporting that disgraced former rugby player Israel Folau has had his controversial GoFundMe campaign cancelled by donation facilitation service, after the company deemed his campaign was in breach of the terms of service.

Folau was asking for $3 million (AUD) to fund a legal challenge against Rugby Australia after they sacked him earlier this year over homophobic social media posts.

People who have already donated to Folau’s campaign will be issued refunds.

In a statement released to the Sydney Morning Herald, GoFundMe’s Australian regional manager, Nicola Britton, said the company was “absolutely committed to the fight for equality for LGBTIQ+ people and fostering an environment of inclusivity.”

“While we welcome GoFundMes engaging in diverse civil debate, we do not tolerate the promotion of discrimination or exclusion,” she said.

The ‘prohibited conduct’ section of their terms and conditions prohibits the raising of funds for the purpose of; “campaigns we deem, in our sole discretion, to be in support of, or for the legal defense of alleged crimes associated with hate, violence, harassment, bullying, discrimination, terrorism, or intolerance of any kind relating to race, ethnicity, national origin, religious affiliation, sexual orientation, sex, gender or gender identity, or serious disabilities or diseases.”

GoFundMe also prohibits raising funds for “any other activity that GoFundMe may deem in its sole discretion to be unacceptable.”

Folau had his contract ripped up by Rugby Australia earlier this year after a social media post in April lumped homosexual people alongside “thieves, liars and drunks” as being destined for hell unless they repented.

It was not Folau’s first time in hot water for homophobic social media posting, with controversial comments in 2018 seeing him disciplined by RA.

After a lengthy code of conduct hearing in May, Folau had his contract officially terminated by the governing body, but launched a legal appeal almost immediately after claiming he had no confidence he’d be treated fairly in an internal appeals process.

He is reportedly seeking $10 million in damages at the Fair Work Commission.

Offside, It's interesting that Folau's comment is often referred to as a homophobic slur, or hateful speech. This is the opinion of those who judged & charged him, for whatever motives. But not necessarily the opinion of mainstream Australia. Apparently we can tell someone from the other side of politics to ours that they're talking crap & they should go to hell. Even without the caveat they should seek redemption. But apparently a religious person can't tell a gay person they're going to hell without the caveat of seeking redemption. And further more, despite the fact Folau suggested a whole heap of people, pretty much all of us, are going to hell unless we repent. But somehow this has been narrowed down to homophobic speech. I'm amazed so many supposedly clever people can get this wrong. Prejudice runs deep in all of us. The first trick is recognising it within yourself.

Sheek: This is now what Folau’s lawyers hoped it would become and that is a large percentage of Australian’s saying and paying to state “No more of this left wing identity politics and persecuting people over what they say”. I think they have had enough of being told what is acceptable and what is not. There is, like Keith WA said yesterday, a lot of people who think this is unfair. My golf mate who is as mean as they come, gave money to IF last night. PS sorry about the open curtain post last night. I should keep this stuff to myself as few understand it.

So why did the ARU apply the "serious breach of the code of conduct" charge if it was a breach of contract? If it was a breach of contract, there would be no need to use a charge that is normally reserved for those who commit assaults, drive drunk or are drug users. But he didn't break his contract, so RA used that charge......RA will be found guilty of wilful dismissal and discrimination.

Interesting you had access to a private meeting? Or did RA come out and say that's what he's agreed too? Because they last time they did that, Israel came out and said they are misrepresenting what he said. So apart from a he said she said meeting, Israel Folau has been sacked for sharing an opinion he is perfectly legally entitled to share. Israel defamed absolutely nobody. Take off your faux outrage and actually read and understand what he said. He said "these people will go to hell UNLESS they repent". Simple as that. He said nothing more than "kids who play on the road will get killed unless they play elsewhere".

Stillmissit, Thanks for that, good stuff. I find this Folau saga increasingly fascinating. The more the loud, shrill voices try to quell him, the more they make him a martyr. As we know, a martyr, for any cause, becomes an almost unstoppable force of its own. This has already gone outside a contract dispute, which is where Qantas RA had hoped it would remain. For those who continue arguing it was a contract breach, is now futile. It's much more than that.

Sorry Ralph I missed this one. I know I said it's irrelevant but thought this with clarifying I think you have your definition a bit wrong. The term comes from fear or aversion to homosexuality which itself comes from the Greek 'homo' meaning ’same'. It's not a base fear or aversion to men. Pretty clear Folau has an aversion to homosexuality and discriminates against them (over say heteros). Like I tried to say above (thanks autocorrect) let's at least be realistic about what those views qualify as If it makes it easier people are obviously complex and their whole person isn't defined by one view. how many racist thoughts do you need to have to be a racist for example (and which ones). Not easily answered definitively. That said I would say that at this point a fair bit of folaus character seems to be being invested in this particular viewpoint and gives fuel to the idea of labelling someone overall as a homophobe with less than average grey area

Sheek: as an old bloke who has been on both sides of this situation I believe there is something in our brains that is all-encompassing, inexpressible and the greatest mystery in this world. I stumbled on it, without looking for it 25 years ago. All of a sudden statements by Buddha, Jesus, Hui Neng, Lao Tzu and other great enlightened people started to make sense. Before this time I had dismissed them all, as Marlin says, 'borderline nutters', stating things that were illogical and incomprehensible. I still prefer the logical but accept that amazing things can happen to you if you sit down and meditate. Then the great mystery that is the mind starts to lose the parts of you that you consider intrinsically important and adds value to things you thought were unimportant. Bits of you are left behind until you hit a place where you're empty and you cannot open your mouth or say one word about what you are experiencing. The next move is a great mystery! Very strange but very wonderful, if you have been there? To tie this back to IF, in the world I exist in all people have the opportunity to be original and genuine. By this, I mean not led by an ideology, parroting cliches or in a closed society but knowing who they are and free at a fundamental level. How can you attack a man like IF who lives in a closed Christian society and his thinking follows their doctrine, is he worse than the people demanding that he suffers for making statements about his ideology? How stupid, small and despicable these people seem and yet they claim to be accepting of all people and particularly minorities - of which IF is an example, outside of mainstream Christianity. You would think minority supporters would flock to defend him not attack him!

So, a question for the (kangaroo) court asked by a mate on facebook. Folau has had his contract terminated by RA for the Wallabies & Waratahs, & presumedly any other Australian pro team. Other national authorities make their own judgment. But what about his amateur status? What if he chooses to play for West Harbour in Shute Shield as an amateur, or perhaps Mosman in Kentwell Cup/Subbies?
