nah if he can just avoid the draft and play for an afl club then it would obviously be WCE which is why i wondered if anyone actually knew how the mechanics would play out. seems like alot of it is just taken in good faith and noone especially the clubs want to rock the apple cart.

Anyway depends on your point of view on whats fair- whichever clubs are involved aside you are either looking from the point of view of the employee or the employer for “fairness”. We arent the judges of this but a quick google says the AFL free agency and draft would likely not stand up in court if tested which will happen one day i suppose.

For the sheer entertainment value i hope its kelly vs geelong as they do appear pretty recalcitrant at least publicly.

looked up the defo of a free agent and come the draft thats exactly what he is if his contract expires at that point so i guess the question is does he have to go in a draft to continue to be an afl player or can he just sign a contract with whoever as a free agent?

Thanks but that doesnt actually explain it either. so at the start of the draft kelly is free to do as he pleases ie he has no contract at that point right? He can go in the draft and wind up wherever or he can stay out of the draft and sign a contract with wce after the draft.

Unless kelly is forced to go in the draft (which i dont think is the case) I dont see how geelong has any real bargaining power if push comes to shove….

what am i missing? some kind of restraint of trade clause from the AFL?

So can someone explain why an out of contract player has to be traded?

I dont follow all the nuances of trade period but no one seems to have explained why, if a deal cant be done fairly, kelly cant just not nominate for the draft and then negotiate a contract with WCE afterwards…

Contrasting the way this grub handles himself at the tribunal vs Hawkins is pretty telling. Both are guilty but one took the adverse result on the chin and said he got a fair hearing while the other lies his way through the hearing with simply incredulous assertions of reaching for the ball etc and then appeals.
Hope they double it on appeal and the giants play cats in the big one with toby on the sidelines while Tom kicks a bag. That would be sweet to see!

No regardless of outcome this has been handled incredibly badly from an administration perspective – the loss of reputation, staff morale, real risk of bankruptcy from litigation, impact on RWC performance, premature actions by key staff, trial by media etc etc.
But yes it is interesting that if you think this has been a good outcome you do tend to think it has been handled well. That is funny.
Trouble is we are not anywhere near the outcome stage yet so still lots of time to agree with me on the mismanagement.

Less revenue is better than bankruptcy and massive reputational damage.
This will be an MBA case study for years to come.
And hopefully also a high court precedent protecting employees rights.
RA will try and settle but IF and his backers will want the ruling.

Well its a free market sponsors can move on and be replaced if they really were that intransigent (im not sure that they were btw). Changing sponsors would have been a far far better result than where things are now with lengthy court cases, and quite possibly bankruptcy for RA. The tail wagged the dog.
