both. The VA seemed to suggest there might be recoverables only achievable if the consortium fund the legal action. So, creditors may get more if they vote up the DOCA and there is litigation so in a way it does rely on it.
No DOCA and funding the litigation to obtain those recoverables becomes much more difficult if not impossible especially as the outcome isn’t certain and the balance of risk v reward changes hugely.
It’s always easier to litigate if someone else is paying for it!

But the consortium are trying to bribe the creditors, including the ATO. Their DOCA offer to creditors is conditional on no action against the directors. So creditors have to balance up the extra return versus the public good of a prosecution. If they sign up for the DOCA they’re bound.

Yep, then withdraw from the arrangement, ex directors walk away with clean records even if reputations are a bit soiled still legally able to hold directorships.
Oh and RA, we want you to sign up to this so we’ll provide the funds to sue you at the same time as you give us the same funding contribution the other SR teams are getting.

It does boggle!
Generally at my work we have had a couple of the warehouse team getting lifts to work (3 × 8hr shifts) because of lost licences and lose someone from the site each year due to random drug test failures.
They aren’t getting paid what these blokes are but it’s still good money especially when compared to Centrelink!

generally I’m really surprised the clubs don’t have the equivalent of Cab Charges just lying around. I suppose those young people have Uber accounts these days which the club could have available.
Maybe it falls foul of the salary cap.

unfortunately some players are just made of glass and there’s no way around that. You just have to deal with the reality of that and as you say, keep for a reasonable price. If he doesn’t like that price then you have to part ways.

By staff who perceive “reducing administrative expenses” and “a ‘razor gang’ taken to costs” means losing their jobs.
Any that can will run for the exits, which means death for the major events that must be implemented to provide the funds.
Organisations are not effective at BAU while major changes like this are taking place. There is a loss of focus not to mention the hours staff have to spend on reporting and change projects.
It’s business lunacy.
