I think the author is stating the obvious. NZ have slipped down in overall standard too. That’s clear. But as long as they can beat the Wallabies and win SRP the whole country will be happy. Pretty much everything there is measured by comparison against Australia. That becomes abundantly clear every time you go there. Rugby, wine, economics (only when they are doing well – not very often), etc, etc.
Some will claim otherwise. But, we know, it’s not easy, being the little brother.
Hence, this article.
He is right though, but we all knew that, didn’t we.
And for the record, they are much, much better at rugby than we are. Always have been, except for a few brief periods of equality.

Fiduciary duties? Yes, very relevant. That is the duty of a Director.

The survival and development of rugby in Victoria is in no way dependent on the survival of the Rebels. It would make a lot more sense for these rugby evangelists to fund a new entity and save themselves $22 million In the process (or whatever proportion of the debt remains after the poor old creditors take it on the chin).
If they were motivated in the way you describe, that is what they would do.
There must be an ulterior motive. And I think if we look at the connections between the consortium and the rebels, we can quite easily work out exactly what that is.

I agree with you. Super Rugby is a failure as a business model. That doesn’t change anything in this mess and it certainly doesn’t excuse the Rebels board from their behaviour.

No comment on this article whatsoever on the lamentable (that is putting it as mildly as it can be described) behaviour of the Rebels board. The Administrators report says it all, make sure you read that before you judge the board or RA in this.
But apparently, we are focussing on the wrong thing. Everyone, the media and the fans, are ‘missing the point’, according to Geoff.
Insolvent trading since 2018, a failure to lodge company returns (which require a declaration of solvency), misuse of RA funds, unpaid PAYE and Super, unfair preference payments (!), and a best case scenario of 15 – 30 cents in the dollar going to creditors if a magic pudding of $18 million materialises from supposedly smart investors who want to ‘invest’ in ‘The Rebels’, and the best bit, RA re license the Rebels board and they are excused and escape any consequences whatsoever, and, wait for it, the main clincher in this deal, they are given the reigns of the franchise to go on their merry way, yet again.
And don’t forget. This great ‘deal’ also includes a promise to engage RA in legal action. So, RA would be absolute fools not to agree to that!
I know who is missing the point here.

Why and how is that the tax collectors responsibility? They took action for the unpaid tax. That is all they can do. They don’t have the power to run or oversee any company. The action on the tax debt is what put the Rebels into administration.

It is the responsibility of the company directors to ensure the company can pay its debts as and when they fall due, not the ATO. It’s ridiculous to try and blame the ATO.

You seem to be suggesting that RA should put the interests of the Rebel’s creditors and directors ahead of the interests of the game of rugby in Australia.
This report is damming of the RA Directors. Yet, you think they should be bailed out and saved from prosecution when there is a finding of 5 years of insolvent trading, payments of unfair preferences and let’s not forget, no ASIC reports since 2017, which avoids the declaration of solvency and keeps it all secret.
So the proposal is to give the same people another $30 Million (the amount the ‘syndicate’ said they could raise, cough) to do it all again?

Yes, Highlanders play right on and often on the wrong side of the line where fair play ends and foul play starts. Very old school club style, reminds me of the great Brisbane Brothers sides of the last century. It kept them in the Rebels game as they got away with a lot.
But gee, they are a very poor side. Landers and Crusaders are the two worst sides out of the NZ and Australian teams in my opinion.
NZ only have 3 competitive teams. Those 3 are very good, but the overall standard of NZ teams has dipped sharply.
