It is clearly an illegal restriction of trade and yes would be abolished if ever challenged at FWC and High Court. I do think it is in the best interest of the game as a whole though. I would consider a legal challenge as the nuclear option and if Tim Kelly would be wary of stating it publicly. Course the Salary cap is also probably an unfair restriction of trade + oppressive behaviour, but I wouldn’t want to see that removed either. Cats need to do the deal for whatever they can get.

It is an employment issue I agree, however there are often clauses in contracts which are unenforceable as they conflict with the Fair Work Act or Common law. Therefore the clause is null and void.
